PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS AND OBLIGATIONS.

1. INTRODUCTION

PharmaFAST PCS Platform (“PharmaFAST”, “we”, “our”, or “us”) is a free-to-use, zero-subscription software service operated by a registered non-profit entity in Ireland. This Software-as-a-Service Agreement (the “Agreement”) governs your use of the PharmaFAST platform, websites, and related services (collectively, the “Services”).

PharmaFAST is designed specifically to support pharmacies in Ireland with tools for managing Primary Care Services (PCS), such as vaccinations, consultations, contraception, and minor ailment services, in accordance with Health Service Executive (HSE) requirements.

2. ACCEPTANCE OF TERMS

By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree with any of these terms, you may not access or use the Services.

3. NON-PROFIT AND ZERO-SUBSCRIPTION STATUS

PharmaFAST is operated by a registered non-profit company in Ireland and is offered at no cost to pharmacies. There are no platform fees, no subscriptions, and no hidden charges. Any optional features or services that may incur charges will be transparently communicated and opt-in only.

4. INTELLECTUAL PROPERTY

All content, software, designs, graphics, and materials within the Services are owned or licensed by PharmaFAST. You are granted a non-exclusive, non-transferable, limited licence to use the Services solely for lawful use within your registered pharmacy.

5. DATA OWNERSHIP & COMPLIANCE

All data entered into the PharmaFAST system by users (“Subscriber Data”) remains the property of the Subscriber. PharmaFAST acts as a Data Processor under the GDPR and will process such data in accordance with applicable Irish and EU data protection laws. A full Data Protection Agreement (DPA) and Data Protection Impact Assessment (DPIA) are provided during onboarding.

6. USER ACCOUNTS

PharmaFAST may provide user-level access for pharmacists, pharmacy staff, and other authorised personnel. Users must protect their login credentials and agree not to share account access with unauthorised individuals.

7. DATA SECURITY

PharmaFAST employs industry-standard security measures, including encrypted data storage, role-based access control, and secure audit logs. Any security breach will be reported to affected users in compliance with the General Data Protection Regulation (GDPR).

8. AVAILABILITY & SUPPORT

We aim to ensure the platform is available 99.9% of the time, excluding scheduled maintenance. While PharmaFAST is free to use, support is available during working hours via email: office@pharmafast.co.

9. ACCEPTABLE USE POLICY

Users agree not to:

  • Use the Services for illegal or fraudulent activities;

  • Upload malicious code or engage in unauthorised data access;

  • Use PharmaFAST to store or transmit infringing or unlawful content.

We reserve the right to suspend access for any violation.

10. TERMINATION

Since PharmaFAST is free to use, you may stop using the Services at any time. PharmaFAST reserves the right to suspend or terminate access for violation of this Agreement or misuse of the platform. Data retention policies are outlined in the DPA.

11. LIMITATION OF LIABILITY

PharmaFAST is provided “as-is” and “as-available.” While we strive for high quality and continuity of service, we make no warranties regarding uptime, performance, or fitness for a particular purpose. In no event shall PharmaFAST, its volunteers, developers, or associated pharmacies be liable for indirect, incidental, or consequential damages.

12. GOVERNING LAW

This Agreement shall be governed by the laws of Ireland. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
